On 1st December 2007 I have started my own office for intellectual property services under the name
Jowi IPS Intellectual Property Services
after having left Shell as Senior Legal Counsel IP after almost 30 years of service with the IP division of Shell with assignments in The Hague, Amsterdam and London.
During the last twenty years with Shell I have gained extensive knowledge of drafting and negotiation of IP agreements and advising the businesses of Shell on complex IP matters. In my portfolio I dealt with, amongst others, innovation projects in the fields of refinery process and petrochemical process technologies and oil and gas exploration technologies. Contract parties were other oil and petrochemical companies, technology licensors, engineering contractors, small and medium sized innovative companies, research organisations and universities.
From 1988 until mid 1996 I have led a negotiation team that successfully negotiated process licence agreements on the Shell EO/EG Process in the Far East (China, India, Japan, Malaysia and South Korea), Saudi Arabia and Mexico.
The first ten years, from 1977 until 1986, I handled patent matters as patent attorney. During that period I was employed for almost a year (1980/81) by the Netherlands Organisation for Applied Scientific Research TNO where I helped to commercialise the knowledge and technology generated by this research organisation.
I am a registered Netherlands Patent Attorney and European Patent Attorney. Further I am a member of the Netherlands Order of Patent Attorneys (“Orde van Octrooigemachtigden”) and the Licensing Executives Society (Benelux). In 2008 I was admitted on the global list of Certified Licensing Professionals.
My academic background is: Studied at the Technical University of Delft (mechanical engineering and industrial design). Bachelor’s degree chemistry with Chemistry Faculty of Leiden University (biochemistry and inorganic chemistry), master degree subject with Law Faculty of Leiden University (patent law) with a thesis “Geneesmiddelen en Octrooibescherming” (medicines and patent protection) - pharmaceutical patents -and master degree with Pharmacochemistry Faculty of Free University, Amsterdam (organic chemistry and pharmacology).

The practice of IP licensing in industry, i.e. the art of world-wide technology licensing, involves as stakeholders not only the technology licensors (technology owners) and the (potential) licensees but in particular where it concerns oil/chemical process licensing also the engineering contractors for process plant engineering, procurement and construction.
Drafting and negotiation of IP agreements (such as licence agreements, technology evaluation agreements, technology development agreements, including EC (European Commission) Consortium Agreements, Public-Private project agreements and secrecy and restricted use agreements), including the provision of solutions as to legal constraints such as requirements of foreign (potential) licensees on the choice of law and fora for dispute resolution are within the field of activities of Jowi IPS Intellectual Property Services.
Also regarding the negotiation with governmental authorities and financial consortia concerning the financing of such projects Jowi IPS Intellectual Property Services provides necessary advice.
Further activities involve the development of and/or the provision of advice on an IP strategy including management/exploitation of patent and trade mark assets and the protection of technical information (by maintaining secrecy or disclosure of technical information under secrecy and restricted use agreements).
In cases of disputes on alleged infringement of IP rights (e.g. patent rights, trade mark rights and copyrights), in particular concerning life sciences legal issues, mechanical engineering issues and chemical process technology issues and/or disputes on IP agreements mediation services are provided to avoid legal proceedings. Patent litigation services in concert with specialized IP lawyers admitted to the bar are provided before the District Court of The Hague. Requests for patent nullity advice given by "Octrooicentrum Nederland" are prepared and handled.
Further intermediary services are provided to competing parties which either on their own or as members of competing consortia require a single - agreed by all - set of template IP agreements, such as secrecy and restricted use agreements and licence agreements on disclosure and licensing of their proprietary technology and innovations. For example in connection with the bidding on and the carrying out of (open innovation) projects of a common client on which they compete with each other. In particular these services may be relevant in case initially competing parties will need to co-operate when the project concerned is carried out.
Jowi IPS Intellectual Property Services further provides interim IP (project) management services including IP legal advice as a member of an executive business committee or steering committee set up for a particular licensing and/or technology development project. Such a project may be a Private project, a Public project or a Public-Private project.
On specific legal aspects of a licensing project and/or technology development project Jowi IPS Intellectual Property Services co-ordinates the provision of advice required from legal advisers specialised in e.g. competition law, dispute resolution (e.g arbitration) and litigation of IP rights, from risk analysis, tax and financial /banking experts and from other IP experts including patent attorneys, patent analysts and trade mark attorneys as and when required.
Furthermore Jowi IPS Intellectual Property Sevices seeks advice from and involves process engineers concerning the handling of a plant process licensing project from a design, engineering, procurement, construction and plant commissioning point of view.

Further Jowi IPS Intellectual Property Services gives a one-day course on interpretation of technical aspects of patent specifications and patent claims, including interpreting technical drawings and formula in patent specifictions. This course has been developed for attorneys at law and judges handeling patent litigation who have had no technical training in mechanical and/or civil engineering, chemisty including life sciences. This course is based on jurisprudence that will be discussed with a focus on the right technical interpretation needed for arriving at a high quality decison and opnion of the court and the attorneys at law respectively. This course is also of interest to business managers (CEO's, CFO's, Marketing Managers and R&D Managers) who have had experience with and/or are involved in patent litigation proceedings.
Jowi IPS Intellectual Property Services also gives a one day course on Alternative Dispute Resolution focussed on patent disputes. This course has been developed for business managers (CEO's, CFO's, Marketing Managers and R & D Managers), IP Counsels (patent attorneys and lawyers) and technology licensing managers.

Gedurende de laatste twintig jaar bij Shell heb ik een uitgebreide kennis opgedaan met het opstellen en onderhandelen van IP overeenkomsten en het adviseren van de Shell business-afdelingen in complexe IP zaken. In mijn portefeuille behandelde ik ondermeer innovatie-projecten op het gebied van rafinaderijproces- en pertrochemische procestechnologieën. Contractpartijen waren andere olie- en petrochemische bedrijven, technologie licentiegevers, ingenieursbureaus, kleine en middelgrote innovatie-bedrijven, researchorganisaties en universiteiten.
Van 1988 tot midden 1996 heb ik een onderhandelingsteam geleid, dat succesvol proceslicentie-overeenkomsten m.b.t. het Shell EO/EG Proces heeft onderhandeld in het Verre Oosten (China, India, Japan, Maleisië en Zuid Korea), Saudi Arabië en Mexico.
De eerste tien jaar, van 1977 tot 1986, behandelde ik octrooizaken als octrooigemachtigde. Gedurende die periode was ik werkzaam voor bijna een jaar (1980/1981) bij de Nederlandse Organisatie voor Toegepast Wetenschappelijk Onderzoek TNO, waar ik heb geholpen om de kennis en technologie door deze onderzoeksorganisatie voortgebracht, te commercialiseren.
Ik ben octrooigemachtigde en European Patent Attorney. Verder ben ik lid van de Orde van Octrooigemachtigden en de Licensing Executives Society (Benelux). In 2008 ben ik toegelaten op de wereldlijst van Certified Licensing Professionals.
Mijn academische achtergrond is: Studie aan de Technische Universiteit Delft (werktuigbouwkunde en industriële vormgeving). Kandidaatsexamen scheikunde aan de Faculteit Scheikunde van de Universiteit Leiden (biochemie en anorganische chemie), doctoraal bijvak bij de Rechtenfaculteit van de Universiteit Leiden (octrooirecht) met scriptie “Geneesmiddelen en Octrooibescherming” en doctoraal examen bij de Faculteit Farmacochemie van de Vrije Universiteit, Amsterdam (organische chemie en farmacologie).

Diensten
De praktijk van IP licentiëring in de industrie, d.w.z. de kunst van wereldwijd licentiëren van technologie, betrekt daarin niet alleen als belanghebbenden de technologie-licentiegevers (technologie-eigenaren) en de (potentiële) licentienemers maar in het bijzonder waar het betreft olie/chemisch processlicentiëren ook de ingenieursbureaus voor procesfabriek (plant) engineering, procurement and construction.
Opstellen en onderhandelen van IP overeenkomsten (zoals licentieovereenkomsten, technologie-evaluatieovereenkomsten, technologie-ontwikkelingsovereenkomsten, daaronder begrepen EC (European Commission) Consortium Agreements, Publiek-private projectovereenkomsten en geheimhouding en beperkt gebruikovereenkomsten), en mede daaronder begrepen het verschaffen van oplossingen voor wat betreft juridische beperkingen, zoals de vereisten van buitenlandse (potentiële) licentienemers met betrekking tot de wetkeuze en fora voor oplossing van conflicten behoren tot de activiteiten van Jowi IPS Intellectual Property Services.
Ook voor de onderhandeling met overheidsinstanties en financiële consortia betreffende de financiering van zulke projecten wordt advies gegeven en diensten verricht door Jowi IPS Intellectual Property Services.
Verdere activiteiten behelzen de ontwikkeling van en/of het veschaffen van advies betreffende een IP strategie daaronder begrepen management/exploitatie van octrooi- en handelsnaambeit en de bescherming van technische informatie (door geheimhouding of onthulling onder geheimhouding en beperkt gebruikovereenkomsten).
In gevallen van conflicten betreffende beweerde inbreuk van IP rechten (b.v. octrooirechten, merkrechten en auteursrechten) en/of conflicten betreffende IP overeenkomsten worden mediation diensten verleend om juridische procedures te voorkomen. Octrooi juridische procedures worden samen met gespecialiseerde IP advocaten gevoerd voor de Rechtbank van Den Haag. Verzoeken om nietigheidsadvies gegeven door Octrooicentrum Nederland worden opgesteld en behandeld. Verder worden intermediair-diensten verleend aan met elkaar concurrerende partijen, die of alleen of als leden van met elkaar concurrerende consortia een – door allen aangenomen – set van template IP overeenkomsten nodig hebben, zoals geheimhouding en beperkt gebruikovereenkomsten en licentieovereenkomsten betreffende onthulling en licentiëring van hun niet onthulde of door octrooirechten beschermde technologie en innovaties. Bij voorbeeld in verband met het bieden op en uitvoeren van (open innovatie) projecten van een gemeenschappelijke klant op welke projecten ze met elkaar concurreren. In het bijzonder kunnen die diensten relevant zijn in het geval, aanvankelijk met elkaar concurrerende partijen met elkaar dienen samen te werken als het betreffende project wordt uitgevoerd.
Jowi IPS Intellectual Property Services verleent verder interim IP (project) management diensten daaronder begrepen het geven van IP juridisch advies als lid van een executive business committee of steering committee, dat voor een bepaald licentiërings- en/of technologie-ontwikkelingsproject wordt geformeerd. Zo’n project kan een Privaat project, een Publiek project of een Publiek-Privaat project zijn.
Voor wat specifieke juridische aspecten van een licentiërings- en/of technologie-ontwikkelingsproject betreft coördineert Jowi IPS Intellectual Property Services het verschaffen van advies van juridische adviseurs, die zijn gespecialiseerd in b.v. mededingsrecht, conflictoplossing (b.v. arbitrage) en procesvoering met betrekking tot IP rechten, van risco analyse, belasting en financiële/banking experts en van andere IP experts daaronder begrepen octrooigemachtigden, octrooianalysten en merkgemachtigden wanneer dat nodig is.
Verder consulteert Jowi IPS Intellectual Property Sevices en betrekt process engineers met betrekking tot het behandelen van een plant process licensing project vanuit het oogpunt van design, engineering, procurement, construction en plant commissioning.
Cursussen voor rond 10 deelnemers
Jowi IPS Intellectual Property Services geeft een eendags- licentiecursus.
Jowi IPS Intellectual Property Sevices geeft een eendags- cursus over interpretatie van technische aspecten in octrooischriften en octrooiclaims, daaronder begrepen technische interpretatie van tekeningen en formules in octrooischriften. Deze cursus is ontwikkeld voor advocaten en rechters die octrooiprocedures behandelen en die geen technische opleiding hebben genoten in werktuigbouwkunde en/of civiele techniek en/of chemie, daaronder begrepen 'life sciences'. Deze cursus wordt gebaseerd op jurisprudentie welke zal worden besproken met een focus op de juiste technische interpretatie welke nodig is voor het formuleren door de rechtbank en de advocaten van een beslissing respectievelijk opinie van hoge kwaliteit. Deze cursus is ook interessant voor business managers (CEO's, CFO's, Marketing Managers en R&D Managers), die ervaring hebben met en/of betrokken zijn bij gerechtelijke octrooiprocedures.

Gedurende die periode was ik werkzaam voor bijna een jaar (1980/1981) bij de Nederlandse Organisatie voor Toegepast Wetenschappelijk Onderzoek TNO, waar ik heb geholpen om de kennis en technologie door deze onderzoeksorganisatie voortgebracht, te commercialiseren.
Ik ben octrooigemachtigde en European Patent Attorney. Verder ben ik lid van de Orde van Octrooigemachtigden en de Licensing Executives Society (Benelux). In 2008 ben ik toegelaten op de wereldlijst van Certified Licensing Professionals.
Mijn academische achtergrond is: Studie aan de Technische Universiteit Delft (werktuigbouwkunde en industriële vormgeving). Kandidaatsexamen scheikunde aan de Faculteit Scheikunde van de Universiteit Leiden (biochemie en anorganische chemie), doctoraal bijvak bij de Rechtenfaculteit van de Universiteit Leiden (octrooirecht) met scriptie “Geneesmiddelen en Octrooibescherming” en doctoraal examen bij de Faculteit Farmacochemie van de Vrije Universiteit, Amsterdam (organische chemie en farmacologie).

Alternative IP Dispute Resolution Approach

Diensten
De praktijk van IP licentiëring in de industrie, d.w.z. de kunst van wereldwijd licentiëren van technologie, betrekt daarin niet alleen als belanghebbenden de technologie-licentiegevers (technologie-eigenaren) en de (potentiële) licentienemers maar in het bijzonder waar het betreft olie/chemisch processlicentiëren ook de ingenieursbureaus voor procesfabriek (plant) engineering, procurement and construction.
Opstellen en onderhandelen van IP overeenkomsten (zoals licentieovereenkomsten, technologie-evaluatieovereenkomsten, technologie-ontwikkelingsovereenkomsten, daaronder begrepen EC (European Commission) Consortium Agreements, Publiek-private projectovereenkomsten en geheimhouding en beperkt gebruikovereenkomsten), en mede daaronder begrepen het verschaffen van oplossingen voor wat betreft juridische beperkingen, zoals de vereisten van buitenlandse (potentiële) licentienemers met betrekking tot de wetkeuze en fora voor oplossing van conflicten behoren tot de activiteiten van Jowi IPS Intellectual Property Services.
Ook voor de onderhandeling met overheidsinstanties en financiële consortia betreffende de financiering van zulke projecten wordt advies gegeven en diensten verricht door Jowi IPS Intellectual Property Services.
Verdere activiteiten behelzen de ontwikkeling van en/of het veschaffen van advies betreffende een IP strategie daaronder begrepen management/exploitatie van octrooi- en handelsnaambeit en de bescherming van technische informatie (door geheimhouding of onthulling onder geheimhouding en beperkt gebruikovereenkomsten).
In gevallen van conflicten betreffende beweerde inbreuk van IP rechten (b.v. octrooirechten, merkrechten en auteursrechten) en/of conflicten betreffende IP overeenkomsten worden mediation diensten verleend om juridische procedures te voorkomen. Octrooi juridische procedures worden samen met gespecialiseerde IP advocaten gevoerd voor de Rechtbank van Den Haag. Verzoeken om nietigheidsadvies gegeven door Octrooicentrum Nederland worden opgesteld en behandeld. Verder worden intermediair-diensten verleend aan met elkaar concurrerende partijen, die of alleen of als leden van met elkaar concurrerende consortia een – door allen aangenomen – set van template IP overeenkomsten nodig hebben, zoals geheimhouding en beperkt gebruikovereenkomsten en licentieovereenkomsten betreffende onthulling en licentiëring van hun niet onthulde of door octrooirechten beschermde technologie en innovaties. Bij voorbeeld in verband met het bieden op en uitvoeren van (open innovatie) projecten van een gemeenschappelijke klant op welke projecten ze met elkaar concurreren. In het bijzonder kunnen die diensten relevant zijn in het geval, aanvankelijk met elkaar concurrerende partijen met elkaar dienen samen te werken als het betreffende project wordt uitgevoerd.
Jowi IPS Intellectual Property Services verleent verder interim IP (project) management diensten daaronder begrepen het geven van IP juridisch advies als lid van een executive business committee of steering committee, dat voor een bepaald licentiërings- en/of technologie-ontwikkelingsproject wordt geformeerd. Zo’n project kan een Privaat project, een Publiek project of een Publiek-Privaat project zijn.
Voor wat specifieke juridische aspecten van een licentiërings- en/of technologie-ontwikkelingsproject betreft coördineert Jowi IPS Intellectual Property Services het verschaffen van advies van juridische adviseurs, die zijn gespecialiseerd in b.v. mededingsrecht, conflictoplossing (b.v. arbitrage) en procesvoering met betrekking tot IP rechten, van risco analyse, belasting en financiële/banking experts en van andere IP experts daaronder begrepen octrooigemachtigden, octrooianalysten en merkgemachtigden wanneer dat nodig is.
Verder consulteert Jowi IPS Intellectual Property Sevices en betrekt process engineers met betrekking tot het behandelen van een plant process licensing project vanuit het oogpunt van design, engineering, procurement, construction en plant commissioning.
Cursussen voor rond 10 deelnemers
Jowi IPS Intellectual Property Services geeft een eendags- licentiecursus.
Jowi IPS Intellectual Property Sevices geeft een eendags- cursus over interpretatie van technische aspecten in octrooischriften en octrooiclaims, daaronder begrepen technische interpretatie van tekeningen en formules in octrooischriften. Deze cursus is ontwikkeld voor advocaten en rechters die octrooiprocedures behandelen en die geen technische opleiding hebben genoten in werktuigbouwkunde en/of civiele techniek en/of chemie, daaronder begrepen 'life sciences'. Deze cursus wordt gebaseerd op jurisprudentie welke zal worden besproken met een focus op de juiste technische interpretatie welke nodig is voor het formuleren door de rechtbank en de advocaten van een beslissing respectievelijk opinie van hoge kwaliteit. Deze cursus is ook interessant voor business managers (CEO's, CFO's, Marketing Managers en R&D Managers), die ervaring hebben met en/of betrokken zijn bij gerechtelijke octrooiprocedures.
Jowi IPS Intellectual Property Services geeft een eendags-cursus over Alternative Dispute Resolution welke gefocust is op gerechtelijke octrooiprocedures. Deze cursus is ontwikkeld voor business managers (CEO's, CFO's, Marketing Managers en R&D Managers), IP Counsels (octrooigemachtigden en juristen IE) en technology licensing managers.
De hierboven genoemde cursussen over technische interpretatie en Alternative Dispute Resolution kunnen gecombineerd worden in een twee-dagscursus.
